The property market has welcomed an important new regulation that is expected to generate thousands of sales across Italy. Following the final approval of Article 44 of the Simplification Bill, the rules surrounding the sale and financing of gifted properties are undergoing radical change.
Buyers will be offered greater protection.
Until now, buying a property that had been gifted to the seller was considered 'complex' due to the risk that the donor's heirs could claim the property in the future. This uncertainty affected buyers' peace of mind and often slowed down negotiations.
The new law definitively eliminates this risk: the purchaser's property becomes untouchable. Even if the heirs were to assert their rights, they would only be able to claim financial compensation from the person who received the original donation, and the new owner of the property would not be affected.
Easier access to credit:
The impact of the reform is equally significant in the banking sector. In the past, the possibility of future claims meant that credit institutions were very cautious about granting mortgages secured by donated properties.
However, with the new rules now in force, the legal uncertainty that held banks back has been eliminated. Consequently, it will be possible to obtain financing and register mortgages on donated properties just as easily as on any other property. This will benefit families, young couples and investors who wish to access credit without bureaucratic barriers.
The value of a more fluid market
In Italy, over 200,000 property donations are recorded every year. This reform finally frees up these assets, allowing donated properties to be placed on the market without fear of 'devaluation' linked to their origin.
Although the reform introduces greater clarity and security, every sale remains a transaction that requires attention and expertise. The property's origin, documentation and specific context must be carefully evaluated. Using qualified professionals protects you, helps you avoid critical issues, and ensures you approach every stage of the sale or purchase with awareness.
